MINUTES OF THE PUBLIC MEETING OF OCTOBER 11, 2011
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:30 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by Frank Schellenger, Chairman, in the Selectmen’s Meeting Room at the Town Hall.

Public Hearings

7:30 PM   Request for Determination of Applicability to determine whether the following scope of alternatives is adequate for work in the Riverfront Area as depicted on referenced plan for the excavation and installation of four canopy footings at 527 Liberty Street, Map 81, Lot 14 for Ferry’s Automotive, Inc.

John Murray read the Public Hearing Notice and the abutters were verified.  Mr. Jack Ferry attended the meeting. Ms. Nehiley read a letter from the SRS Petroleum Services, LLC dated 9/29/11 which outlined the scope of work which is to take place within the 200’ riparian zone.  The catch basin is to have a silt sock installed around it during construction to catch any runoff from the site and excavations will be covered with tarp overnight.   No abutters were present.

7:45 PM  Continued After the Fact Notice of Intent for an Emergency Project involving the demolition and removal of a dilapidated commercial structure at 1101 Main Street, Map 42, Lot 60A for Joseph Marangiello, J & M Realty Trust represented by Land Planning, Inc., 1115 Main Street, Hanson, MA  02341  (DEP #SE175-0608)

Mr. Marangiello attended the meeting.  Mr. Steve Wry submitted a Request for Variance (dated 10/11/11) from the 50’ No Build setback and a revised plan (dated 10/10/11) depicting the locations of the proposed test pits as per request of the Commission.   Mr. Wry requested that the Commission allows a special condition to permit for the pumping, treatment and discharge of the water from the foundation once approvals are received from the U.S. EPA and the MassDEP.  Mr. Schellenger replied that a Request for an Amendment would be required for the dewatering activity.

Discussion

Vandalism at Webster Billings Property
Ms. Nehiley updated the Commission on the vandalism that occurred last week on Sunday, 10/2/11 at the Webster Billings Conservation Area.  It was reported by Phil Lindquist, former Chairman on Monday, 10/3/11 at which time the Hanson Police were notified.  Ms. Nehiley said that the damage included the destruction of conservation signage at two locations:  at the end of Old Pine Drive and at the end of Puritan Drive.  Also, conservation plaques that were used to mark trails were spray-painted and the boundaries of a new blazed trail were scattered.  All of the improvements to the Area had been performed by Brendan Keane as part of his Eagle Scout project for Troop 34 only three weeks prior.  Brendan and his father, Kevin Keane, assistant Scout Leader, attended the meeting to seek approval to repair the damage done.

Old Business/New Business

Conservation Restriction
Mr. Schellenger said a memo from the Selectmen’s office requested that the acceptance of the Birchbark Drive conservation restriction be put back on the agenda.  Mr. Schellenger reiterated that the Commission had already voted not to accept.  No one was in favor of revisiting the issue.
